Terms & Conditions: Workshops

INTRODUCTION

These Terms and Conditions govern the relationship between Eugene Theron (referred to as “Eugene Theron”, "we," "our," or "us") and the participants (referred to as "you", “your”, “attendee(s)” or "participant(s)") in our landscape photography workshops. By registering and participating in our workshops, you agree to comply with these terms and conditions.

WORKSHOP REGISTRATION:

  • Participants must be at least 18 years old to register for and attend our workshops.

  • Workshop registration is subject to availability and is on a first-come, first-served basis.

  • To secure a spot in the workshop, a non-refundable deposit or full payment may be required, as specified in the workshop details.

WORKSHOP FEES:

  • Workshop fees include the cost of instruction, guidance, and access to designated photography locations, as outlined in the workshop description.

  • Workshop fees do not cover transportation, accommodation, meals, travel insurance, or any personal expenses unless explicitly stated.

WORKSHOP CONTENT & ITINERARY

  • Workshop details, including locations, dates, and itineraries, are subject to change based on weather conditions and other factors. We will make reasonable efforts to provide suitable alternatives.

  • We reserve the right to modify or cancel parts of the itinerary if circumstances arise that are beyond our control, without any liability

PAYMENT OF FEES:

  • A non-refundable deposit (stated for each workshop) is payable at the time of booking.

  • For non-residential workshops, tuition and online workshops, etc full payment is required at the time of booking. This included a non-refundable deposit of £50 included within the price.

  • Payment and receipt of the deposit does not confirm acceptance of the booking by us. We will confirm acceptance of the booking once we are sure booking criteria have been met. If we do not confirm acceptance the deposit will be refunded in full.

  • Your place will only be secured once full payment has been received.

  • The outstanding balance for any workshop is due 120 days before the commencement of the workshop. Should this payment not be made by this time, we reserve the right to cancel your booking, relist the space and retain your non-refundable deposit.

  • If the booking is made less than 120 days prior to the commencement of the workshop, the full amount is payable at the time of booking.

CANCELLATION AND REFUNDS:

  • Cancellation by Participant:

    • All cancellations must be made in writing at least 30 days prior to the commencement of the workshop.

    • Cancellations made within this period will be refunded, less the non-refundable deposit

    • Cancellations made less than 30 days prior to the commencement of the workshop will be liable for the full workshop fee.

    • All workshop sales are governed by the UK Online & Distance selling regulations that states all online purchases are subject to a 14-day cooling off period. Should you change your mind within 14 days of paying either the deposit or full amount at time of booking you will be entitled to a full refund. This does not apply to paying the balance of the workshop fee.

    • Refund amounts will be calculated based on when written confirmation of the cancellation is received. The refund amount will be calculated based on the total price of the workshop, not including the non-refundable deposit unless within 14 days of purchase:

      • 1 - 14 days after purchase (full refund including non-refundable deposit)

      • 120 - 31 days prior to workshop commencement (50% refund)

      • 30 - 0 days prior to workshop commencement (0% refund)

    Cancellation by Eugene Theron:

    • We reserve the right to cancel any workshop. In the event of a workshop cancellation, for reasons for reasons other than Force Majeure, by Eugene Theron you will be notified as soon as is reasonably possible.

    • Fees for workshops cancelled by Eugene Theron will be processed as a full refund, including the deposit paid.

    • In the unlikely event that we need to cancel a workshop due to unforeseen circumstances (including, but not limited to, illness or injury), an alternative workshop will be offered or another workshop leader provided. If the offer of an alternative workshop or alternative workshop leader is not accepted the participant will receive a full refund of the workshop fee, including the deposit paid.

    • In the event that the workshop leader has 2 leaders where 1 is unable to attend, the workshop will proceed with 1 leader (or an alternative leader) or may be cancelled. In the event that the workshop is cancelled, a full refund will be made.

    • We are not responsible for any additional expenses you may have incurred, such as travel or accommodation.

  • Force Majeure

    • We accept no responsibility for cancellation of workshops due to Force Majeure.

    • A force majeure event refers to any unforeseeable and unavoidable event that is beyond the reasonable control of either party, including but not limited to acts of God, natural disasters, war, riots, terrorist activities, government regulations or actions, extreme weather conditions, pandemic, epidemic, disease outbreak, strikes, labour disputes, and other events of a similar nature.

    • If the workshop cannot be conducted as scheduled due to a Force Majeure event, no refund is due and both parties will work together to determine a suitable alternative date for the workshop. The participant agrees to be flexible with the rescheduled date.

    • If the Force Majeure event makes it impossible to reschedule the workshop or if the participant cannot attend the rescheduled date, both parties agree that the workshop may be cancelled. In such cases, any payments made by the participant will be refunded minus any non-refundable expenses already incurred by the organizer.

TRANSFER OF WORKSHOP(S)

  • Bookings are non-transferrable between participants and / or workshops.

LIABILITY:

  • We are not responsible nor liable for any personal injury, loss, damage, or theft of participant's equipment or belongings during the workshop.

  • We are not responsible or liable for any personal injury, loss or death caused to you during the workshop.

  • All workshop attendees participate at their own risk. Eugene Theron accepts no responsibility for injury or damage to their persons or property. Participants are encouraged to have insurance that covers their health, travel (including cancellation), gear and damage to property.

  • By accepting the loan of any equipment from a workshop leader you accept responsibility for any damage or loss as this equipment is no longer covered by our insurance. In the event of damage or loss, you agree to pay immediately for the new items to be replaced from a supplier of the workshop leaders choosing, in order for business continuity to occur. In the event that the item is no longer available, an equivalent must be paid for even if the amount exceeds the original purchase price.

PARTICIPANT RESPONSIBILITIES & BEHAVIOUR:

  • Participants are responsible for their own safety and well-being during the workshop. Participants must follow all safety guidelines and instructions provided by the workshop leader.

  • Participants are expected to have a reasonable level of fitness and mobility to fully participate in outdoor activities.

  • Should any participant have a medical or health condition that may affect their participation, it is the responsibly of the participant to inform Eugene Theron prior to attending the workshop.

  • All clients must be in possession of a valid passport and all visas, permits and certificates, including medical certificates required for the whole of the journey and the client accepts responsibility for obtaining the same. All information and advice given by us on visas, vaccinations, climate, clothing, baggage, special equipment etc is given in good faith.

  • Participants are responsible for their own photography equipment, including its maintenance, insurance, and operation.

  • Respect the environment, local communities, and their customs.

  • Discrimination, hostility, anti-social, or aggressive behaviour of any kind is strictly not tolerated. Eugene Theron reserves the right to remove participants from workshops due to any such behaviour. No refund will be given.

  • Drones are not permitted on workshops unless specifically stated.

USE OF PHOTOS:

By attending any type of workshop you grant permission for the use of any photographs or videos of you taken during this period. These media may be used for any marketing or social media purposes. If you don’t want these media to be used, please inform us in writing prior to the commencement of the workshop.

ACCEPTANCE:

By paying the deposit, or full amount (if applicable) and receiving confirmation of your booking, you are agreeing to accept these Terms and Conditions. In the event of one person paying the deposit or workshop fee for a group booking, they accept that they do so on behalf of all the individuals included in the booking so that all participants are bound by the same Terms and Conditions.

REFUSAL:

  • We reserve the right to refuse any booking or reservation without giving a reason.

APPLICABLE LAW:

  • These terms and conditions are governed by the laws of England and Wales. Any disputes arising from these terms will be subject to the exclusive jurisdiction of the courts of England and Wales.

  • Any dispute arising from the contract must be confirmed by you in writing within 30 days of the workshop taking place.

  • By registering for our landscape photography workshops, you acknowledge that you have read, understood, and agreed to these terms and conditions. If you have any questions or concerns, please contact us before registering.
